
Prosecutors in the punishment phase of Tanner Lynn Horner’s capital murder case have presented compelling evidence showing that the former FedEx driver did not simply “panic” after hitting 7-year-old Athena Strand with his delivery van — he had been planning the abduction and killing in advance.
Athena disappeared on November 30, 2022, from her father’s home in Paradise, Texas. Horner, who was delivering packages that day, was accused of striking the little girl with his van, abducting her, and then strangling her with his bare hands inside the vehicle when he feared she would tell her family. On April 7, 2026, Horner shocked the Tarrant County courtroom by pleading guilty to capital murder and aggravated kidnapping, moving the trial directly into the sentencing phase where jurors must decide between the death penalty and life without parole.
During opening statements in the punishment phase, Wise County District Attorney James Stainton laid out evidence of premeditation that directly contradicts Horner’s initial claim of a spontaneous panic. One of the most damning pieces involves Horner’s movements the day before the crime. Prosecutors stated that Horner was on the same road, near Athena’s home, 24 hours earlier — at a different house with a different girl. This prior reconnaissance suggests he was already familiar with the area and potentially scouting opportunities.
Even more telling is Horner’s decision the following day. After the alleged incident, instead of returning the truck or switching vehicles as part of his normal routine, Horner made sure to keep the same FedEx truck for the rest of his deliveries. Stainton described this as turning the vehicle into his “mobile crime scene,” allowing him to continue working while concealing evidence throughout the day. Video from the truck reportedly shows him driving through the area again after the abduction.
The location where Athena’s body was found further supports the theory of planning. Her remains were discovered on December 2, 2022 — 72 hours after she vanished — in a creek at BoBo Crossing along the Trinity River near Boyd, Texas. The site is approximately six miles (as the crow flies) from her father’s home in Paradise, though the driving distance is around 12–13 miles. Horner himself led investigators to the remote dump site after his arrest, demonstrating knowledge of the secluded area.
Forensic evidence recovered at the body site and from Athena’s person also points to a prolonged and violent struggle rather than a quick, panicked act. Horner’s DNA was found under Athena’s fingernails, indicating she fought desperately for her life. Additional DNA from Horner was discovered in places on the 7-year-old’s body where it should never have been present, further evidencing sexual assault or other intentional acts during the crime.
Prosecutors emphasized that Horner continued making deliveries for hours after the abduction, showing calculated behavior rather than immediate remorse or fear. He allegedly attempted to break Athena’s neck first but, when that failed, strangled the tiny 67-pound girl with his bare hands while he weighed 256 pounds. Audio and video evidence from inside the van reportedly captured parts of the horrifying ordeal, including Athena sitting upright and aware in the back of the truck in what may have been her final moments.
Athena’s mother, Maitlyn Gandy, has spoken powerfully about the loss. She has displayed the still-sealed box of “You Can Be Anything” Barbies — the Christmas gift Horner was delivering — and the innocent letter Athena wrote to Santa Claus. These items stand as heartbreaking symbols of the bright future stolen from the vibrant little girl with bright blue eyes and an ornery smile who loved Christmas more than anything.
Gandy has advocated for stricter safety measures for delivery companies, reminding the public that no child should ever be at risk from someone trusted to simply drop off a package. The case led to the creation of “Athena Alert,” aimed at faster responses to missing children.
As the punishment phase continues — expected to last up to three weeks — jurors will hear victim impact statements and further evidence of Horner’s character and actions. The discovery site evidence, prior scouting, retention of the “mobile crime scene” truck, and forensic DNA all paint a picture of premeditation that prosecutors argue warrants the ultimate punishment.
Athena’s story continues to touch millions, serving as a tragic reminder that danger can hide behind the most routine moments — a delivery van in the driveway, a child playing outside, a holiday gift on its way. Her family’s courage in facing this unimaginable loss ensures her voice and dreams are not forgotten, even as justice seeks to hold her killer accountable for every calculated step he took.
